Terms and Conditions

1. AGREEMENT TO TERMS

By utilizing the services of Tattered Atlas LLC, hereafter referred to as "the Agency," the client acknowledges and agrees to abide by the terms and conditions outlined herein.

2. OUR SERVICES

a. Travel Agency Role: Tattered Atlas LLC operates exclusively as a travel agency, facilitating the booking of travel-related services on behalf of clients. The Agency is not a supplier of travel services but acts as an intermediary between clients and third-party suppliers, including airlines, hotels, tour operators, and other service providers.

b. Supplier Relationships: The Agency maintains professional relationships with a network of suppliers to provide clients with access to a wide range of travel options. However, the Agency does not own, operate, or control these services and is not liable for the acts, errors, omissions, or negligence of the suppliers.

​

c. Limitation of Liability: Tattered Atlas LLC is not responsible for the quality, safety, or any issues related to the services provided by third-party suppliers. Any claims or disputes arising from the use of supplier services should be directed to the respective supplier.

​

3. BOOKING AND RESERVATIONS

a. Supplier Cancellations: The Agency is not liable for any cancellations or modifications made by suppliers, including but not limited to flights, hotels, tours, and other travel-related services. Any claims or disputes arising from such cancellations or modifications are to be directed to the respective supplier.

​

b. Weather and Force Majeure Events: The Agency shall not be held responsible for disruptions, cancellations, or alterations to travel plans resulting from adverse weather conditions, natural disasters, or force majeure events. It is the client's responsibility to obtain suitable travel insurance to mitigate any financial loss.

​

4. SERVICE FEES

a. Agreed Upon Fees: The client agrees to pay the Agency's agreed-upon service fees, including planning and travel design fees, rebooking fees, and any additional fees as specified in the service agreement.

​

5.  PRICING

a. Price Guarantee: Prices and quotes provided by the Agency are guaranteed for the date and time of receipt only. Prices are subject to change based on the terms and conditions of the suppliers. Clients are advised to review and confirm pricing at the time of booking to avoid any discrepancies.

b. Supplier Terms: The Agency is not responsible for changes in pricing or promotions made by suppliers. Clients are bound by the pricing and terms set forth by the suppliers at the time of booking.

​

6. CLIENT RESPONSIBILITIES

a. Accuracy of Information: The client is responsible for providing accurate and complete information required for travel arrangements. The Agency shall not be liable for any issues arising from inaccuracies or omissions in the information provided by the client.

​

b. Compliance with Laws and Regulations: The client shall comply with all applicable laws and regulations of the destinations they visit. The Agency is not liable for any consequences arising from the client's failure to adhere to local laws and regulations.

​

7. CHECK-IN AND DEPARTURE RESPONSIBILITIES

a. Check-In Times: Clients are responsible for adhering to airline check-in times, which generally require check-in no later than 2 hours before domestic flights and 3 hours before international flights. Failure to comply with check-in times may result in denied boarding, and the Agency is not liable for any associated consequences.

b. Supplier Recommended Procedures: Clients are required to follow all check-in and departure procedures recommended by third-party suppliers, including airlines, hotels, and tour operators. This includes adhering to baggage guidelines, security protocols, and any other supplier-specific requirements.

​

c. Documentation: It is the client's responsibility to ensure they possess all required travel documentation before departure. This includes, but is not limited to, passports, visas, vaccination certificates, and any other documents stipulated by suppliers or destination authorities. The Agency is not liable for denied boarding due to insufficient or incorrect documentation.

​

d. Supplier Communication: Clients must stay informed about any communication from suppliers regarding changes to departure times, gates, or other relevant information. Failure to stay informed may result in missed flights or other disruptions for which the Agency is not responsible.

​

e. Baggage: Clients are responsible for adhering to airline baggage policies, including weight limits and fees for excess baggage. The Agency is not responsible for any additional costs or inconveniences related to baggage.

​

f. Transportation Arrangements: Clients must arrange for timely transportation to and from departure points, including airports and cruise ports. The Agency is not responsible for missed departures due to transportation issues.

​

g. Timely Communication: In the event of unexpected delays or disruptions, clients are required to communicate promptly with the Agency and follow any instructions provided.

​

h. Weather and Force Majeure: In the case of disruptions due to adverse weather conditions, natural disasters, or force majeure events, clients must adhere to supplier instructions and updates. The Agency is not responsible for consequences resulting from such events.

 

Clients acknowledge that compliance with these check-in and departure responsibilities is essential for a smooth travel experience, and any failure to do so may result in additional costs or disruptions for which the Agency is not liable.

8.  DOCUMENTATION

a. Agency Assistance: Clients have the option to employ the services of Tattered Atlas LLC for documentation purposes. The Agency can assist in obtaining visas, travel insurance, and other required documentation on behalf of the client.

​

b. Client Responsibility: Whether clients choose to utilize the Agency's documentation services or handle it themselves, they are solely responsible for the accuracy of information provided, obtaining proper documentation (including passports, visas, etc.), and ensuring compliance with the requirements of destination authorities and suppliers.

​

c. Documentation Errors: Tattered Atlas LLC is not liable for any errors, omissions, or delays in documentation processing that may result in denied boarding, travel disruptions, or any associated consequences.

​

9. LIMITATION OF LIABILITY

a. Third-Party Services: The Agency acts solely as an intermediary between the client and third-party service providers. The Agency shall not be liable for the acts, errors, omissions, or negligence of these third-party providers.

​

b. Indemnification: The client agrees to indemnify and hold harmless Tattered Atlas LLC, including its owner Allison Stalnaker, from any claims, losses, damages, liabilities, costs, or expenses arising from the client's use of the Agency's services.

​

10. TERMINATION OF SERVICES

a. Termination by the Agency: The Agency reserves the right to terminate its services to the client at any time, without refund, if the client fails to comply with these terms and conditions or engages in behavior that hinders the successful operation of the Agency.

​

11. GOVERNING LAW

a. Jurisdiction: These terms and conditions are governed by the laws of the state of Colorado, and any disputes arising from the client's use of the Agency's services shall be resolved in the courts of Fort Collins.

​

12. MODIFICATION OF TERMS

a. Amendments: The Agency reserves the right to modify these terms and conditions at any time. Clients will be notified of any changes, and the revised terms shall apply to all subsequent bookings.

​

13. PAYMENT SCHEDULE

a. Deposit Requirement: A deposit, to the supplier is required to secure the booking. Deposits may be refundable or non-refundable in accordance with the terms of the supplier. Failure to provide this deposit may result in the cancellation of the reservation by the supplier.

​

b. Interim Payments: Clients authorize the use of their credit card for interim payments. The Agency will notify clients before charging their card, specifying the amount and purpose of the charge.

​

c. Final Payment Deadlines: Final payment deadlines are not flexible. Clients risk cancellation by the supplier upon failure to make the final payment by the specified date.

​

14. LATE PAYMENTS

a. No late payments are allowed.

b. Consequences of Non-Payment: Non-payment may result in the cancellation of the trip by the supplier, in accordance with their terms. The Agency is not liable for these consequences.

​

15. CANCELLATION FEES

a. Cancellation fees incurred are subject to the terms of the suppliers.

​

b. The Agency is not responsible for supplier cancellation fees.

​

16. REFUND POLICIES

a. Service Fee Nonrefundable: The service fees charged by the Agency are nonrefundable.

​

b. Other Refunds: Refunds for services beyond the agency's fees are subject to the terms of the suppliers.

​

17. TRAVEL INSURANCE

a. Strong Recommendation: The Agency strongly recommends clients purchase comprehensive travel insurance.

​

b. Non-Purchase Liability: The Agency is not liable for consequences resulting from the client's decision not to purchase travel insurance.

​

18. COMMUNICATION CHANNELS

a. Communication Channels: Communication will occur through phone, mail, email, text, and direct messaging on Instagram and Facebook.

​

b. Professional Communication: Communication must be professional. The Agency reserves the right to cease communication if it becomes unprofessional, inappropriate, and/or disrespectful.

​

19. RESPONSIVENESS

a. Timely Responses: Timely responses are necessary to ensure applicable promotions and rate codes can be applied. The Agency is not responsible for changes in promotions or rates due to unresponsive clients.

​

b. Payment Information: Clients acknowledge that providing timely payment information is essential for securing bookings promptly.

​

20. CONFIDENTIALITY

a. Confidential Information: The client's personal information, including passport and credit card details, will be handled with the utmost confidentiality.

​

b. Data Protection: The Agency complies with data protection laws to safeguard the client's sensitive information.

​

21. FORCE MAJEURE CLAUSE

a. Definition: Force majeure events include, but are not limited to,  natural disasters, pandemics, war, terrorism, and other unforeseeable circumstances.

​

b. Implications: In the event of force majeure, the Agency shall not be liable for disruptions or cancellations and will follow the procedures outlined in the supplier's terms.

​

22. DISCLAIMERS

a. Changes in Itinerary: The Agency is not liable for changes to travel itineraries due to factors beyond its control, including but not limited to supplier cancellations, weather events, force majeure, political unrest, or any other unforeseen circumstances.

 

b. Supplier Actions: The Agency is not responsible for the actions, errors, omissions, bankruptcy, or financial default of any third-party suppliers, including airlines, hotels, tour operators, and transportation services.

 

c. Health and Safety: The Agency is not responsible for any health-related issues, accidents, injuries, or illnesses that may occur during travel. Clients are advised to obtain suitable travel insurance to cover unforeseen medical expenses.

 

d. Price Volatility: The Agency is not responsible for price fluctuations in travel-related services, including but not limited to airfare, accommodation, and tour prices. Prices are subject to change based on supplier policies and market conditions.

e. Accuracy of Information: Information on the Agency's website or promotional materials may be subject to change, and the Agency is not liable for discrepancies in real-time updates.

​

23. INTELLECTUAL PROPERTY

a. The Agency retains all rights to its intellectual property, including but not limited to logos, brand names, and website content. Unauthorized use or reproduction of any intellectual property is strictly prohibited.

24. WEBSITE USERS AGREEMENT

a.  Acceptance of Terms: By using the Agency's website, users agree to abide by the terms and conditions outlined herein.

 

b. Intellectual Property: Users agree not to reproduce, distribute, or use any intellectual property displayed on the website without explicit permission from the Agency.

​

c. Accuracy of Information: The Agency strives to provide accurate and up-to-date information on its website but is not responsible for any errors or omissions.

​

d. Website Security: The Agency is not liable for any unauthorized access, hacking, or security breaches on its website. Users are responsible for maintaining the confidentiality of their login credentials.

​

e. Third-Party Links: The website may contain links to third-party websites. The Agency is not responsible for the content, accuracy, or security of these external sites.

​

f. User Conduct: Users agree to engage in respectful and appropriate conduct on the website. The Agency reserves the right to suspend or terminate access to users who engage in inappropriate behavior.

​

g. Data Collection: The Agency collects and uses user data in accordance with its Privacy Policy. By using the website, users consent to the collection and use of their data.

By engaging with the services of Tattered Atlas LLC, the client acknowledges having read, understood, and accepted these terms and conditions. This agreement constitutes the entire understanding between the parties and supersedes any prior agreements or understandings, whether written or oral.
